eBay sued for ‘at least $3.8 billion’

eBay is being sued for “at least $3.8 billion” by XPRT Ventures, which is accusing it of violating six patents to “develop lucrative payment systems”. The complaint, filed yesterday, says “eBay allegedly stole information shared in confidence by the inventors on XPRT’s own patents, and incorporated it into features in its own payment systems, such as PayPal Pay Later and PayPal Buyer Credit”, states Reuters , continuing: “XPRT said that when eBay on April 30, 2003 filed a patent application titled ‘Method and System to Automate Payment for a Commerce Transaction,’ it failed to tell the U.S. Patent and Trademark Office it knew of XPRT’s own patent applications.

RapidShare has made several drastic changes to its service in the last months. They began in March when it became apparent that the company was trying to get copyright holders on board in an attempt to convert pirates into paying customers. A month later RapidShare ditched its CEO Bobby Chang on claims he was no longer the right person to successfully lead the company.

Judge Nullifies Gene Patents

A federal judge on Monday nullified patents associated with human genes known to detect early signs of breast and ovarian cancer. It was the first time a federal court has invalidated a patent on genes. The American Civil Liberties Union, which brought the case, said the New York federal court decision “calls into question the validity of patents now held on approximately 2,000 genes.” U.S.

Mac cloner guilty, but "hackintosh" tools will persist

Apple has won a landmark victory against Mac clone maker Psystar, though it doesn’t spell doom for the rest of the hackintosh industry just yet. US District Judge William Alsup ruled late last Friday that Psystar had violated Apple’s copyrights when distributing Mac OS X with its machines, and that the company was also in violation of the anti-circumvention provisions in the Digital Millennium Copyright Act. As a result, Judge Alsup dismissed Psystar’s counterclaims and ruled in favor of Apple, but Apple still has a long road ahead if wants to shut down other hackintoshers.

In May, the ACLU announced that it was suing to invalidate a patent that covers testing for genetic variants associated with breast cancer. The suit targeted Myriad Genetics, which licenses the patent, and the University of Utah officials that licensed it to them, but also targets the US Patent and Trademark Office, which allowed this form of gene patent in the first place. In a move that surprised no one, each of the three defendants filed motions to have the case against them thrown out.
